Interconnect Notification (Ref: 03107)

In relation to the invoices for transit sent by BT following the OFCOM determination of disputes dated 7 July 2007 relating to mobile call termination rates, BT has received queries from a number of CPs.

  • By this briefing, BT confirms that it is not happy with the determination and is actively considering whether or not to appeal the determination. BT shall inform CPs of its decision on this matter early next month.


  • CPs have also asked BT about the contractual basis upon which it can raise the transit invoices sent last month. Ofcom referred to this subject in paragraph 6.56 and 6.57 of the determination. The sending of these invoices arises from the application of paragraphs 12 and 13 of the main body of the BT's standard interconnect agreement, and, in particular, paragraphs 12.3 to 12.7.


  • It should be noted that in relation to the retrospective amendment of transit charges, BT faces the same issues of retrospective recovery of monies from originating customers as every originating CP.

      The lowering of termination rates will result in credit notes being issued by BT to CPs already invoiced. Customers who have paid the relevant invoice may use the credit note against their BT conveyance invoice.
